Justice Kennedy sticking around through at least Jan. 20, 2013
Veteran Washington reporter Tom DeFrank reports that Justice Kennedy plans to wait at least until the end of President Obama's first term before he hangs up his robe. Justice Kennedy is 74 years old, and "has told relatives and friends he plans to stay on the high court for at least three more years..."
Someone might have some unfinished business.

There's nothing stopping her from stepping down in 2011, which I am assuming will not happen based on her hiring of clerks.

No. I'm referring to the fact that she is old and had a recent battle with cancer.

Does this actually change anything? Obama still needs a second term to have a high likelihood of replacing Ginsburg and a conservative (either Scalia or Kennedy).

He's pulling a reverse Souter. LA times and wapo reported that Souter, before November, told friends that he would retire if Obama won.
