For the government to force ISPs to refrain from discriminating against certain kinds of content is essentially a virtual taking. They government is telling ISPs that they have to use some of their (limited) bandwidth in a particular way.
I was originally for net neutrality, but after reading an article, "Virtual Takings: The Coming Fifth Amendment Challenge to Net Neutrality Regulation" by Daniel Lyons, my view has changed slightly. I still would like to see net neutrality, but if this taking is to occur, the ISPs have to be fairly compensated.

Is it "discrimination" that the Post Office charges me more to send a 50-pound package than to mail a first-class letter?

It will be interesting to see what will happen when ISP's are charging crazy rates and then public WiFi becomes available everywhere (via White Spaces)
