Scopes II

The first trial over a challenge to the introduction of "intelligent design" into the public school curriculum gets under way today in Harrisburg, PA.  This will be worth watching.

I think this case should be known as "Scopes III," since "Scopes II" was used to describe the case in Hawkins County, TN in the late 1980s -- or perhaps even "Scopes IV", in light of the hearings in Kansas on intelligent design in 2004 (which were also labeled "Scopes II").

Do I hear "Scopes V," anyone? :):)

What is there to try? Shouldn't any case like this go off on summary judgment? I mean, what issues of fact are there? Presumably, the fact of the teaching of intelligent design is undisputed...

From that article, it sounds like the ACLU wants to put on evidence that intelligent design is unscientific. But why can't they just knock out the "science" on the I.D. side with a daubert motion then get summary judgment?

Or is an irresponsible district court judge just letting both sides do a show trial?
