Spencer was a 1L professor of mine and is a brilliant and terrific person; I'm delighted to see this. It's also great to see (though I have no great quarrel with Iqbal and broader anti-plaintiff trends in civil procedure myself), and to the Chief Justice's distinct credit, the Chief Justice appointing to the Advisory Committee such an outspoken critic of Iqbal, the new discovery rules, and even of the Chief Justice's praise of those rules in his year-end report.*
